As that my health has not improved and I'm still unable to work, I find myself in a pretty tight spot with no income after five months. Thus I'm going to start selling off pieces that had been done for LA Gallery in Canada. They had contacted me last year and asked if I still had certain pieces, which I did not, so they asked if I wouldn't mind recreating them with some differences and then adding new pieces to this lot. The goal was to get twenty pieces done for them. This was a big break for me as that LA Galleries has branches in LA (USA) an Paris, these are brick and mortar REAL places not just an online presence. The trouble with online galleries is that NO ONE will EVER see your work. I had a deadline which was March 1st. Sadly due to my stay in the hospital I missed the deadline (the first time I ever miss one) and the contract I had with them was void. I've tried resubmitting and thought I'd hold the pieces, adding to them (my goal was to get forty done) and search out other galleries. But my present state forces me to have to break these pieces out and sell them. I'll be posting a few at a time and will be offering them as a FIRST COME, FIRST SERVED basis, after 24 HOURS of my posting them, anything not sold in this manor will be posted on Etsy. Like it or not people, this is where I'll be selling my work until eBay allows me back and even then, not all of my work will be on eBay. Etsy is FREE to join and is easy to use. You sign up and buy. Easy as that. Its where Leonard Nimoy (you know, the original Spock from Star Trek) sells his work, so its good enough for me and you.<br />

As that its been a while, I wanted to give everyone an update. Yes, I'm still doing art :) I've been having some stomach troubles and am going in for a colonoscopy on the 23rd of this month. After that, I'll know what's going on and how to deal with it. Its taking me a little longer to get some projects completed, thus the delay in seeing new work. This has me feeling exhausted most of the time, which has made it hard to get any work done. As soon as I can after the 23rd, I'll post an update.<br />

VARA is short for Visual Artists Rights Act. Its protected me. Here's how: I was doing some volunteer work for my local library, they asked me to paint some fantasy figures on some new books cases for the children's section. I was never given a deadline, despite my asking for one. I told them that I'd need to take paying work first and may have to take some time off here and there. I also showed them detailed drawings of everything that was going to be featured. They agreed to everything. I told them on more than one occasion that the job would take me about 2 - 3 months. Again, all was agreed. After about a month and a half I became very sick. I let them know. They never said anything to me. About a week later i go down to work on them and see that they've gotten another person (I won't say artist as that they work was both crude and childish) to take over what I had already started. This included painting over some of my figures. I told them they couldn't do with without my written consent. I was told that I didn't own the bookcases that library and thus the town did. I got a lawyer who deals with Intellectual Property Law. He write them a nice letter stating they could touch my art because the art and the creative process behind it was owned by me. They ignored his letter. He wrote them again stating that if they didn't stop work immediately, we would sue them for the maximum amount allowed by law. This time, copies of the letter went to the library's board of director's, the head librarian, the town conical and the town's lawyer. Included was a copy of VARA for them to look over. Yes, they owned the building that the bookcases were housed in. Yes they owned the bookcases. But they did not own the art and thus couldn't alter it in any way because it was owned by me. So the bookcases to this day remained unfinished and I check on them now and again. I've been <span lang="en-US">busy</span> with a lot of things all going on at once. Aside from the holidays, we were without power for about 9 days, which was not fun. </p> <p style="margin-bottom: 0in;">I am offering the below as an example, nothing more. Do some <span lang="en-US">research</span>, read up on contracts and how to deal with them. I'm not offering anything but a suggestion and anyone reading this and failing to obtain work or loses a job(s) or any client who get <span lang="en-US">rejected</span> by an artist because of this blog, please note that I'm offering my suggestions as nothing more than an example. Following them or failing to do so, does not in any way legally bind me to anyone or their work. I do not represent any lawyer, <span lang="en-US">law firm</span> or artist on any way.</p> <p style="margin-bottom: 0in;">I mentioned in my last blog that I would talk about contracts, so here's the skinny: They are what you NEED in EVERY job. Do not start or even think of beginning a job without one. If the client asks for a sample or two (or more) before committing to a contract, you're only response is a firm, no comprise, “No”. The trouble is a lot of young artists will feel pressured to make that deal and end up <span lang="en-US">comprising</span> themselves a well as many losing jobs because they feel they have to, “pay their dues”. Well, paying them means that you work you trail off and never give up. Any client who wants you to do samples before submitting to a contract is telling you a tale tale and looking to get you for nothing. You want to be taken seriously? Want to be respected and be a professional? Then if they don't offer a contract at the start, then you do. If you're going to be doing a charity job, then protect yourself, and even though you're doing the work for free, you make sure that you're covered by a contract. A lot of things can happen in any job, no matter how large or small, so make sure there's a contract to protect you. </p> <p style="margin-bottom: 0in;">When the client offers the <span lang="en-US">contract</span>, then you take a good look at it, read EVERYTHING and make sure that you understand. If you have any questions, seek out an <span lang="en-US">attorney </span> who handles Intellectual <span lang="en-US">Property</span> Law. Many will give <span lang="en-US">you a</span> free <span lang="en-US">consolation</span> and can answer your questions. Do searches online for any contracts that you might need. There are also several books for artists that have contract in them and all you need is to print them up. </p> <p style="margin-bottom: 0in;">And just so that you know, when you talk about a deal with anyone who's hiring you, make sure that you save ALL e-mails (if they offer you a job via e-mail, then you state what you want for that job, and they agree, that's a <span lang="en-US">contract</span> but make sure if you can to get a real one, with signatures), record the phone conversation (letting them know that you're doing so before to start talking about anything, of course) and even if you're simply talking to them, then its a good idea to have someone with you because anything said can either come back to haunt you or free you. It was a volunteer job and was planned out and was going to take several <span lang="en-US">months both</span> due to its size (a <span lang="en-US">mural</span> to be painted on the backs of some books cases) and I had to work it in between paying jobs. Now I went to the Broad of <span lang="en-US">Trustees</span> about how I'd have to work this out and no one said that it would be a problem. No deadline was given. I had expected this to take a while, with myself and my friend and fellow artist Shawn Myers ( <a href="http://profile.myspace.com/index.cfm?fuseaction=user.viewprofile&friendID=171205616">http://profile.myspace.com/index.cfm?fuseaction=user.viewprofile&friendID=171205616</a> ) working on it. Soon after we had started, problems began to rise. First the <span lang="en-US">Broad</span> of Trustees (BoT) wanted to place a plaque right on the art itself as <span lang="en-US">opposed</span> to placing it on any of the other places where the art would not be damaged. This wouldn't have been a big deal had they not been planning this without talking to either Shawn or myself, as that we would have made room for it. So we were shocked <span lang="en-US">and</span> the BoT did what every group of small minded, power <span lang="en-US">hungry</span>, egoists would do: They denied everything. Ok. Now I want to stress here that we were both proud and excited to be working on this <span lang="en-US">project</span> until this came up. The fact that the BoT had done this behind our backs for nothing other than to show they had power and could play with people's minds. You know what? They came and spent about ten <span lang="en-US">minutes</span> with Shawn and I as they went over all of the art and claimed that THERE WAS NOTHING WRONG WITH ANY OF IT!!! At this point, they became the WORST people that I have EVER had to work for. Shawn an I agreed <span lang="en-US">that all</span> we wanted to was to get this job over with as fast as possible. A couple of things happened to slow us down. One was that we both ended up having car trouble and couldn't get to the library. When my car was repaired I went back to <span lang="en-US">work</span>, despite coming down with what the doctors had thought was Lyme <span lang="en-US">Decease</span> (I'm getting better, but that isn't what I had and <span lang="en-US">they don't</span> know what I had/have). I ended up asking them to time off so that I could feel better. I was feeling totally <span lang="en-US">exhausted</span> and couldn't get my own wok done and had fallen behind. They all agreed and even went as far as to promise (that word was used, in front of witness') me that I would be able to complete the job when I got better. Well about two weeks later I get an e-mail from a friend telling me that they were “doing things” to my art and I should check it out. I ended up going a week later as that driving was a feat. What I saw horrified me. They had gotten someone else (who couldn't paint) to come in and FINISH my work WITHOUT MY PERMISSION. Now any artist worth their weight will know that despite that the bookcases are owned by the library, the art is MINE. This is covered under VARA. Ok, so now I'm pissed and have a <span lang="en-US">lawyer</span> working on it. If I chose to take them to court, I plan on <span lang="en-US">suing</span> them for every penny I can get and making sure that the BoT and library staff is completely replaced by people who would actually work FOR the library (the BoT has done such a <span lang="en-US">wonderful</span> job, hiding the times of the public meetings so that no one knows when they're held, wasting money that's marked for the <span lang="en-US">library</span> on needless things like <span lang="en-US">expanding</span> the parking lot- <span lang="en-US">instead</span> of the library-, holding back fact they're supposed to be getting $10,000 a year that's supposed to go towards building a new library and either not getting it, asking for it, or... , playing power games with the library staff and forcing them to work off hours and having to take work home – a no-no in anyone's book- threatening the staff with being fired unless they do to things that aren't library related or making them keep <span lang="en-US">things</span> quite that the public and <span lang="en-US">Town</span> Selectmen should be made aware of – young adult books dealing with <span lang="en-US">sex</span> and violence in graphic manors in the CHILDREN's section and often right next to books little kids can get to with no warning of any kind and so on). <p style="margin-bottom: 0in;"> Now the point in all of this is this: Make sure you HAVE A CONTRACT, even if its a volunteer job and you don't expect anything in return. A job is a job, no matter what it is and you make sure that you backside is covered. I didn't do this and if I <span lang="en-US">had a</span> contract, I would have been laughing my way to court right now. I want to talk about models. Right now, I'd say that my biggest Muse, would be Wendy. </p> <p face="arial" style="margin-bottom: 0in;"> Of all of the models I've used to date, very few have the quality that Wendy has. Wendy is the <span lang="en-US">successor</span> to the long line of women who've dressed as Red Sonja and appeared at <span lang="en-US">conventions</span> all over the country. No matter the costume, Wendy brings something that is sadly missing in many women who've posed for me: Style. Its a rare thing. She has this quality that we often over look these days. Her beauty is <span lang="en-US">reminiscent</span> of Bettie Page. She has a way of bring life to the simplest of poses, be it a gesture with her hand or the look in her eyes. She brings the viewer in and captures them with those eyes. I have found in her that very rare thing that any artists seeks when they find the “right” model: A Muse that speaks to them telling them that they are being inspired by True Beauty. This is no common thing. And an artist who finds it knows that they have it.
